1. General The contract made by you on-line with us incorporates these terms and conditions, which shall prevail over any and all terms and conditions, proposed by you.
You shall be unable to proceed with your purchase until you have read and agreed to these terms and conditions, and signified your acceptance by clicking the box at the end of these terms.
The contract shall not have been concluded until validation checks and authorisation by SECPay Ltd has been received by us. If the issuer of your payment card refuses to or does not, for any reason, authorise us, we will not be liable for any delay or non-delivery.
2. Payment We reserve the right to change our prices from time-to-time. All reasonable efforts will be made to update the website of any price changes as they occur. The price will not be altered once we have received and accepted your on-line order. Methods of payment are set out in our current delivery & payment information page.
3. Delivery and Acceptance All products wherever possible will be dispatched to you within thirty (30) days of receiving your order. Whilst we make every effort to dispatch the products on time, we do not accept liability for any failure to deliver within that time period.
Once your order is processed we will give you notification of despatch. Our orders are dispatched by post or courier and should reach you within thirty (30) days of dispatch. If the order has not reached you within this time, please contact us on +44 (0) 1388 818882 (calls charged at the normal national/ international rates) during office hours of 0830 to 1800 GMT on Monday to Friday (excluding Bank and Public Holidays in the UK).
Some of our products may not be in stock at the time you place your order. In the event that we cannot deliver the products within thirty (30) days of receipt of your order, we will contact you upon receipt of the order to advise you of the actual situation and take instructions as to how you prefer we proceed, or, if you prefer, to arrange a refund.
4. Your Right To Cancel You have seven (7) working days from the day after taking delivery of the products at your home to cancel. You may return the products without reason. A refund of the purchase price will be made in full within thirty (30) days of cancellation. Where the goods have not been returned within this period, a deduction may be made from the refund to cover the reasonable costs of collecting the goods. You will be responsible for the cost and the safe return of the products. Risk of damage to the returned products lies with you at all times.
You must let us know of your decision to cancel the contract within 7 working days after the day you have received the goods and any notification must be in writing and sent by e-mail post or fax. This does not affect your statutory rights as a consumer. We have implemented and embraced the Consumer Protection (Distance Selling) Regulations 2000.
5. Warranties Any complaint about the products made under warranty must be made in writing and received by us within thirty (30) working days of delivery. You shall allow us to investigate any such claim after return and inspection of the product. You may contact us by e-mail at info@kingandcountry.co.uk. We endeavour to respond to all complaints within five (5) working days.
If you do receive the products in an unsatisfactory condition please retain all relevant documentation so that an insurance claim can be made against the carriers insurers. If you received damaged products, bring this fact to the notice of the carrier, and ask him to note it in writing, even before you open the packaging to examine the contents. If you are unable to open a damaged package in the presence of the carrier, make sure that you sign for it as 'damaged package - products not yet inspected', or something similar, so as to warn the carrier that a claim may be forthcoming.
To cover the circumstances, please contact us by e-mail or telephone with as much detail of the damage or loss as you can provide as soon after delivery as possible, so that the Company can arrange for the dispatch of replacement products and follow up the difficulty with the carriers. Please do not return damaged products to the company unless or until requested to do so as this may incur additional costs unnecessarily.
Products returned under complaint, should be returned by courier/post-paid. We will happily arrange an exchange, credit or refund of the full purchase price paid for the products, once we have examined them, but the cost of the return delivery by you cannot be refunded if the goods are rejected as unwanted. Please note that the refunds will normally be made using the same method as the original payment ie, a credit or debit card, or other form of payment. Any refund will be made within thirty (30) days of cancellation.
6. Site Content and Disclaimers We have used reasonable care and skill in compiling the content of our website but make no warranty, express or implied, as to the nature or accuracy of any material on the website and cannot accept liability for any particular material on the website or as a result of any use of or reliance placed upon information contained within its website.
Every effort is made to ensure complete accuracy, however some prices/details contained on the website may change from time to time and it is possible that errors will occur. We will use our best endeavours to rectify any errors as swiftly as possible but will not be responsible for any loss incurred. All products and prices are subject to availability.
We have a policy of continuous product development and reserve the right to amend the specifications of products. Products supplied may differ as a consequence from those on display or advertised. Unless agreed with you, the products supplied will be of equivalent value, functionality and appearance.
All on-line promotional items are subject to availability. You cannot transfer the value of the offer products to any other products. We reserve the right to make modifications and changes to products, prices or offers without notice. We suggest that you periodically review our website to view all promotional offers. Any material downloaded or otherwise obtained through the use of the service is done at your own discretion and risk and that you will be solely responsible for any damage to your own computer system or loss of data that results from the download of any such material.
7. Intellectual Property Intellectual Property includes but is not limited to our trade marks and service marks, website content and domain names owned by King & Country UK.
We respect the Intellectual Property of others, and we ask you to do the same.
King & Country is a registered trade mark and service mark and is owned by the Company, King & Country Limited (Hong Kong). You must not use, adapt, alter or amend any of our logos, and site content without our prior written permission.
8. Data Protection Compliance At all times we will observe the requirements imposed by the Data Protection Act 1988 ("The Act") and we will provide the appropriate security to maintain the confidentiality of your personal data. We are a registered Data Controller under the Act, number PZ6134164.

10. Force Majeure We shall not be liable for any failure or delay in performance under this Agreement caused by causes beyond our reasonable control and occurring without our fault or negligence, including, but not limited to Acts of God, floods, hurricanes or other natural disasters, wars, insurrection, riots and/or any other cause beyond our reasonable control.
11. Proper Law and Jurisdiction We control and operate our Website from our offices within England. Accordingly the laws of England and Wales govern claims relating to, including the use of, this Website and the materials contained herein. If you choose to access our Website from outside England and Wales, you do so on your own initiative and you hereby agree that in the event of a dispute between King & Country UK and you the laws of England and Wales will apply at all times.
